PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE PLAYING ANY OF THE GAMES OF T-BAAR.COM, with headquarters located in France ("T-BAAR" "WE", "OUR" "US"), LOCATED AT t-baar.com (THE "Site"), OR ACCESSED THROUGH third party platforms, including social networking sites ("Third Party Platforms").

Introduction and agreement to these terms of use

By playing our games (the "Games") or using any of our applications, products or services (collectively, the "Service"), you represent that you have read, understood and agree to be bound by these Terms of Use (the "Terms") and consent to the collection, use and storage of your information as outlined in T-BAAR.COM’s Privacy and Cookie Policy.

If you do not agree to the Terms now, or if at any time, the Terms are no longer acceptable to you, please cease use of the Site and Service immediately. These Terms constitute a binding agreement between you and T-BAAR.COM.

T-BAAR.COM reserves the right to refuse any user access to the Site and/or Service without notice for any reason, including, but not limited to, any violation of the Terms. You agree that T-BAAR.COM may discontinue the Service or change the content of the Service at any time, for any reason, with or without notice, and without liability.

Age restriction

If you do not agree with all of these Terms, or you are not at least thirteen (13) years of age, or you are between the ages of thirteen (13) and eighteen (18) and your legal guardian does not agree with all of these Terms, please do not access and/or use the Site or Service.

How do I comply with the T-BAAR.COM Terms of Use?

By using T-BAAR.COM’s Service you agree NOT to:

Virtual currencies/goods

The Service may include the option to purchase virtual, in-game currency (“Virtual Currency”) by using legal tender as well as virtual, in-game goods (“Virtual Goods”) by using the in game's virtual money. This can only be done if you are considered a legal adult in your country of residence.

All Virtual Currency and Virtual Goods are deemed to be final and non-refundable, unless stated otherwise at our discretion. You will have no right or title to any Virtual Goods and/or Virtual Currency you acquire.

T-BAAR.COM has absolute control over all Virtual Currency and Virtual Goods and at any time has the right to change the value, modify and/or eliminate any Virtual Currency and Virtual Goods as it sees fit and without any liability.

No refunds will be given by T-BAAR.COM. The Virtual Currency and Virtual Goods have no real currency value, cannot be redeemed for real money, and can only be used within the Games offered by T-BAAR.COM. Other than a limited, revocable, non-transferable license to use the Virtual Currency or Virtual Goods in the Games, you have no right in or title to such Virtual Currency and Virtual Goods. In the event that your account is terminated or suspended for any reason, in T-BAAR.COM’s sole and absolute discretion, or if T-BAAR.COM discontinues its Games, you forfeit any and all Virtual Currency and Goods. T-BAAR.COM has the absolute right to manage, regulate, control, modify, and/or eliminate Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion, and T-BAAR.COM shall have no liability to you or anyone for the exercise of such rights.

Termination

We reserve the right to terminate or suspend your account or access to any or all of the Games at any time and for any reason. It is within our sole discretion and determination to terminate your account for what we deem to be a violation or breach of these Terms. In the event that we terminate or suspend your account, you will have no further access to your account or anything associated to it. As stated above, you will not be entitled to a refund of any Virtual Currency or Virtual Goods acquired or developed during the Games.

Disputes between users

T-BAAR.COM may at any time intervene in disputes between you and other users, but is under no obligation to do so. T-BAAR.COM will not be liable for anything resulting from these disputes, including, but not limited to, claims and damages, of any kind.

Disclaimer of warranties

THE SITE, SERVICE, AND GAMES, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WE DO NOT REPRESENT, WARRANT, OR GUARANTEE THAT THE SITE, SERVICE, OR GAME, WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED. You agree that your access and use of the Site, Service and Games shall be at your sole risk. To the fullest extent permitted by law, T-BAAR.COM, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the Site, Service and Games and your use thereof, including implied warranties of title, merchantability, fitness for a particular purpose, non-infringement, accuracy, authority, completeness, usefulness, and timeliness. T-BAAR.COM makes no warranties or representations about the accuracy or completeness of the content of the Service or the content of any sites linked to the Service and/or Site and, to the fullest extent permitted by applicable law, assumes no liability or responsibility for any:

Limitation of liability

T-BAAR.COM’S AGGREGATE CUMULATIVE LIABILITY TO YOU ARISING FROM OR RELATING TO THESE TERMS, THE SITE, SERVICE, AND GAME, FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE TOTAL AMOUNT YOU HAVE PAID T-BAAR.COM IN THE TWELVE (12) MONTHS PRECEDING THE DATE OF THE CLAIM GIVING RISE TO THE LIABILITY.

Under no circumstances will T-BAAR.COM be liable to you or any third person for any indirect, incidental, special, punitive, or consequential damages whatsoever including any lost profits or lost data arising from your use of the Service, Site or other materials on, accessed through or downloaded from our Service and/or Site, whether based on warranty, contract, tort, any other legal theory, or whether or not T-BAAR.COM has been advised of the possibility of these damages.

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that T-BAAR.COM shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Intellectual property ownership

You acknowledge that all intellectual property rights in our Site, Service, Games and the underlying technology, and all information and content available on our Site and through the Service, excluding User Content (as defined below) but including the Games, characters, Virtual Currency and Virtual Goods (collectively, the “Service Content”), are owned by us and/or our suppliers (including other users).

The Service Content is protected by copyright laws throughout the world. Subject to your compliance with these Terms, T-BAAR.COM grants you a limited, non-exclusive, non-transferable, non-sublicenseable, revocable license to view and use the Service Content for your personal non-commercial entertainment purposes. No other use of the Service Content is authorized. In consideration of this authorization, you agree that any copy of the Service Content that you make shall retain all copyright and other proprietary notices in the same form and manner as on the original.

You may not otherwise use, download, upload, print, display, perform, reproduce, publish, license, post, transmit, modify, create derivative works of, reverse engineer, disassemble, decompile, adapt, distribute, transfer, or exploit any Service Content in whole or in part without our prior written authorization. We and our suppliers (including other users) reserve all rights not granted in these Terms. There are no implied licenses.

All trademarks, logos and service marks displayed on the Site or Service (“Marks”) are our property or the property of other third parties. You are not permitted to use these Marks without our prior written consent or the consent of such third parties which may own the Marks.

User content

You agree that you are willingly publishing the content on the Service and/or Site using technology and tools provided by T-BAAR.COM. You understand and agree that you may not distribute, sell, transfer or license this content and/or application in any manner, in any country, or on any social network or other medium without the explicit written permission of T-BAAR.COM. You grant T-BAAR.COM the right to act as an agent on your behalf as operator of the application.

Any data, text, graphics, photographs and their selection and arrangement, (hereinafter “User Content”) uploaded to the Service and/or Site are subject, whether in whole or in part, to unlimited commercial, non-commercial and/or promotional use by T-BAAR.COM. Text, graphics, and photographs are uploaded by you and are the sole responsibility of the person from whom the User Content originated. Thus, users are responsible, and T-BAAR.COM is not responsible, for any files users upload, post, or otherwise make available. T-BAAR.COM may or may not regulate User Content and does not guarantee the accuracy, quality, or integrity of any User Content posted via the T-BAAR.COM application. By using the Service and/or Site, you acknowledge and accept that you may be exposed to material you find offensive or objectionable. You agree that T-BAAR.COM will not under any circumstances be liable for any User Content, including, but not limited to, errors in any User Content, or any loss or damage incurred by use of the User Content. T-BAAR.COM does not have the obligation to and will not monitor any User Content but has the right, in its discretion, to remove any User Content in case of a complaint.

These Terms constitute the entire agreement between you and T-BAAR.COM regarding your use of our Site, Service, and Games, and supersede and replace any prior written or oral agreements regarding the foregoing. Our failure to exercise or enforce any right or provision in these Terms shall not operate as a waiver of such right or provision. If any provision of the Terms is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions. Neither the rights nor obligations arising under these Terms are assignable by you, and any such attempted assignment or transfer shall be void and without effect. We may assign these Terms without restriction. These Terms and any action related to these Terms will be governed by and interpreted under the laws of France.

Privacy and Cookie Policy

T.BAÄR, with headquarters located in France (“T.BAÄR” or “we”) is dedicated to protecting the privacy rights of our online users (“users” or “you”). This Online Privacy and Cookie Policy (the “Policy”) has been crafted to inform you as to the ways we collect, store, use, and manage the information you provide in connection with any T.BAÄR game or application (“Service”). Please note that the scope of this Policy is limited only to information collected by T.BAÄR through use of the Service. T.BAÄR’s primary objective in collecting user information is to provide and enhance the Service and to enable users to easily navigate and enjoy the Service. This includes sending you electronic communications related to the Service, from which you can unsubscribe at any time using the instructions in such communications.

When you install any of the T.BAÄR games or applications, we may collect and record the information you provide us voluntarily through the social networking website in accordance with their policies and terms.

When you play a T.BAÄR game, on T.BAÄR's website at t-baar.com (the "Site") or on your social network page or on someone else’s page or through your mobile device, we may record information regarding the use of that game, and we may collect other information that is visible on your social network page in accordance with the relevant terms of use associated with that page.

The Service will also record game play information such as your high scores or game session duration. When you invite new members into your network or send messages through T.BAÄR’s applications, we collect and maintain the information associated with those messages, including facebook user ID and content.

When you pay for products offered for purchase though the Service, we use the Facebook Payment Lite service that collects your billing address and complete credit card information to enable us to receive your payment. Our payment processing service provider may also retain this information to enable you to purchase additional items through our Service without having to re-enter it each time. We do not directly access, store or collect your credit card information and we will not use your payment information we collect except as needed to fulfill your purchase and/or communicate with you regarding your transaction.

T.BAÄR will never at any time ask you for your credit card or bank account information, your login or password, or national identification numbers via any unsolicited means, including email and telephone calls.

Public Information

Some of the information you give us when you register to play our games is open to the public, such as your profile picture, number of friends, and your username.

Cookies

Like many websites, T.BAÄR uses server log files and automated data collection tools, such as cookies and web beacons (collectively, “Data Collection Tools”) when you access our Service and/or use the Site. We tie the information gathered by these means to our customers’ personally identifiable information. Please note that third party partners/providers, such as facebook services in our games or on the website and/or Service, may also use cookies or other technologies, and those practices and providers are subject to their own policies.

Our services may contain third party tracking tools from our service providers, examples of which include Google Analytics. Such third parties may use cookies, APIs, and SDKs in our services to enable them to collect and analyze user information on our behalf. The third parties may have access to information such as your device identifier, MAC address, geo-location information, and IP address for the purpose of providing their services under their respective privacy policies. This Policy does not cover the use of tracking tools from third parties. We do not have access or control over these third parties.

Google Analytics

T.BAÄR also uses a tool called “Google Analytics” to collect information about use of this Site. Google Analytics collects information such as how often users visit this Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. T.BAÄR uses the information it gets from Google Analytics only to improve this Site. Google Analytics collects only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information. T.BAÄR does not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site, the cookie cannot be used by anyone but Google.

Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use (as amended for government websites) and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this Site by disabling cookies on your browser or mobile device.

Sharing of personal information with third parties

Except as set forth in this Policy, T.BAÄR does not share your personal information with any third parties. In the event we offer services or promotions where your information is separately collected and used according to the privacy policy of a third-party, we will inform you of that at the time of collection and you may elect not to participate in the service or promotion. We also may share your information with third parties as required by law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose you or us to legal liability.

We may share your information with third party companies that perform services on our behalf, including payment processing, order fulfillment, data analysis, marketing services, email campaigns, hosting services, and customer service. While providing the services for us, these companies may access your personal information, and are required to use it solely as directed by us for the purpose of our requested service.

In conjunction with the running of our games we may partner with a third party to assist us in providing you with our Service. We will share the information you provide us through your social network such as (1) your first and last name, (2) your profile picture or its URL, (3) your user identification number of the pertinent social network, which is linked to publicly available information such as name and profile picture (4) the login email you provide to the pertinent social network upon registration; (5) game play information with these third parties so they may facilitate the use of our Service as well as contact you about other games which may be of interest to you, service notifications and to solicit your feedback and input. If you do not wish to have this information shared please do not use our Service. We may use and share with third party advertisers (and other third parties) certain technical information and other non-personal information to show general demographic and preference information among T.BAÄR users. We may also allow advertisers to collect technical information and other non-personal information, which they may share with us, through the use of tracking technologies like cookies and web beacons. The information collected may be used to offer you targeted ad-selection and delivery in order to personalize your user experience by increasing the likelihood that advertisements for products and services you see will appeal to you, a practice known as behavioral advertising, and to undertake web analytics (i.e. to analyze traffic and other end user activity to improve your experience).

Information about our users is an integral part of our business. We neither rent nor sell your personal information to anyone. We share your personal information only as described in this Policy.

Protecting personal information

We strive to protect personal information while it is under our control. Your account information is accessible online only through the use of a password. To help protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. You acknowledge that you provide your personal information at your own risk. You are also responsible for all uses of the T.BAÄR games and applications by any person using your password. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use, disclose, or alter your personal information for improper purposes. Also please note that email and messaging systems are not considered secure, so we discourage you from sending us personal information through these mediums.

In the event that personal information has been or is compromised as a result of a breach of security, T.BAÄR will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Policy, or as otherwise required by applicable law.

To protect your privacy and security, we take reasonable measures (such as requiring a unique password) to verify your identity before permitting you access to your account or the Service. You are responsible to maintain the secrecy of your unique password and account information, and for controlling access to your email communication or interaction through the Site or T.BAÄR's authorized social networking at all times.

Accessing, correcting and deleting your personal information

T.BAÄR takes your privacy seriously and works in a transparent way. In that sense, upon providing sufficient identification (to protect others' privacy), you can request information from us about the personal information we hold in relation to you and you can correct any inaccurate data we hold.

Furthermore, you can change or delete any personal information by changing the applicable information found in your T.BAÄR account. However, by deleting the entirety of this information your account may become deactivated.

Links to other websites of applications

Links from the T.BAÄR applications to third party Web sites or applications are provided for your convenience. In addition, content in T.BAÄR applications may be hosted by other websites or applications. Any personal information you provide on the linked pages or applications is provided directly to that third party and is subject to that third party's privacy policy, not ours. These other sites and applications maintain their own policies regarding cookies and the collection and use of personal information. It is up to you to review those policies yourself.

Policy regarding children under the age of 13

T.BAÄR's Service is not directed to children under the age of 13 and T.BAÄR does not knowingly collect nor solicit personal information from anyone under the age of 13 or knowingly allows such persons to access our Service. If you are under 13, please do not attempt to register for the Site or send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from a child under the age of 13 we will delete that information as quickly as possible. We recommend that minors over the age of 13 ask their parents or guardians for permission before sending any information about themselves to anyone over the Internet.

Communication

If you contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply. We may use your personal information submitted in your communications to contact and respond to you.

Changes to this policy

T.BAÄR may amend this Policy from time to time. Use of information we collect now is subject to the Policy in effect at the time such information is used. If we make changes in the way we use personal information, we will notify you by posting an announcement on our Service or sending you an email. You are bound by any changes to the Policy when you use the Service after such changes have been first posted. If you object to any change, your sole recourse shall be to immediately terminate your account and cease using the Site and Service.

Refund Policy

All purchases of Virtual Currency and Virtual Goods are deemed to be final and non-refundable, unless stated otherwise at our discretion.

No guarantee of reimbursement is given or implied through the policies outlined herein. T.BAÄR will at no point provide cash refunds, though we may choose to reimburse users with game currency or virtual products at our sole discretion.

Reimbursement for technical issues

While we strive to provide a fun and stable environment for players to enjoy our games, technical issues may occasionally arise that may disrupt the game service. While we cannot prevent all such possible issues, the Support Team strives to help players who experience technical problems as quickly and efficiently as possible.

If you experience a technical issue while you're playing and have sustained some game losses, you may contact our Support Team via the designated email address for that game to let us know what happened. Please provide any available screenshots along with a detailed description of your issue and your request. We will not process player claims without supporting documentation as definitive evidence for these cases. When we receive a request for reimbursement, a Support Team member will review your request, verify the details, and take the appropriate action at the sole discretion of the Support Team and Support Team Supervisor.

The Support Team will investigate each case on a case-by-case basis at its discretion. Any compensation or recompense granted is case-specific and implies no obligatory action on similar cases. No T.BAÄR employee outside of our designated Support Team is authorized to reimburse you or appeal the team’s decisions.

As a rule, reimbursements will not be given by T.BAÄR unless the Support Team is able to verify that the loss occurred due to a game irregularity outside of normal gameplay, primarily as the result of a documented bug or server error. All reimbursement requests must be sent within a week (7 days) from when the loss occurred to be considered for reimbursement. Any requests submitted after such time will not be considered.

Issues which are NOT considered valid for reimbursement include, but are not limited to, the following: 1. Potential or theoretical gain. Only assets lost when already in possession of the player are eligible for reimbursement. 2. Any losses attributable to problems with a player's system (i.e. computer, Internet connection, etc.) or any system owned by a third party are not eligible for reimbursement. 3. Being banned from the game for violating the In-Game Policies. 4. Timing out as a result of inactivity on your computer.

Spamming with petitions or emails requesting reimbursements or giving false information in an attempt to receive compensation are not permitted and may result in disciplinary action being taken against your account.
